Oliver to learn if can ride on Derby Day

Champion jockey Damien Oliver will know on Monday if his reckless riding charge has been downgraded and if he can ride in Saturday’s prestigious Victoria Derby meeting.

Oliver accepts he is guilty of careless riding over his winning ride on Flying Artie in the Blue Sapphire Stakes on October 12 but argues it did not constitute riding in a reckless manner.

The rider took his case to the Victorian Civil and Administrative Tribunal after losing a Racing Appeals and Disciplinary Board challenge to the reckless riding charge, where he also failed to have the 20-meeting suspension reduced.

VCAT vice president Judge Pamela Jenkins will announce her decision on the reckless riding charge at 11am on Monday.

She will then hear submissions on penalty from barristers for Oliver and Racing Victoria.

Even if he fails to have the charge downgraded, Oliver hopes to get his suspension period cut so he can ride at Saturday’s Victoria Derby meeting, which features four Group One races.

The suspension began after the Caulfield Cup and meant Oliver missed the Cox Plate ride on French horse Vadamos, who came fourth on Saturday.

He is currently due to return on Melbourne Cup day.
